SPECIALIZATION
During a Notary public act, if one of the parties is a foreign national the Italian law demands the support of a translator selected by both parties in accordance with the section 55 of Notarial Law. Therefore it is necessary to appoint a sworn translator. The Notary verifies the identity of the appointed translator, the competence and the ability to execute the professional functions required. In addition to this the Notary will ensure that the appointed translator has the skills to carry out the correct translator and to convey the real will of both parties to effectively negotiate the agreement.
The legal instrument is drawn up in Italian and subsequently the interpreter translates it in the language required by the foreign party and swears an oath before the Notary that the official duties will be faithfully undertaken.
Usually the Notary reads the drawn act in Italian and then the translator reads the related translation in a language chosen by the foreign client in a manner that both parties thoroughly understand the content of the legal instrument and its legal consequences. In case the foreign party requires clarifying some aspects of the document the Notary will explain it helped by the present interpreter. Finally, the parties, Notary and present translator sign the bilingual deed.
